The real estate law includes all legal issues surrounding the rights of land. In the narrower sense, the real estate law mainly includes legal issues relating to the land purchase contract and the so-called rights in real estate. Legal basis of the real estate law are predominantly regulations of the civil law book. According to the degree of entitlement, the real estate law distinguishes between the full right on a property (property), the land rights (leasehold) and the limited real rights.
The law provides for a special type of contract for the transfer of a right to a plot because of the usually high importance and the high value of land. The contractual property purchase contract or donation agreement for a real estate requires the notarial certification in order to be effective. Notarization by a notary serves primarily to inform the landowner of the scope of his actions. The notary has a duty to provide comprehensive information and must inform the contracting parties comprehensively about all legal consequences of their actions.
